NT: Mandatory reporting of domestic violence in the NT

DARWIN, Feb 18 AAP - The Northern Territory has become the first jurisdiction in Australia
where it will be illegal not to report incidents of domestic violence.
The new laws to protect women and children were passed by the NT parliament on Wednesday
in what NT chief Minister Paul Henderson called "a significant and historical day".
It is now illegal not to report domestic violence if a woman's life is believed to be in danger.
Police must also be contacted if a person has caused or is about to cause serious harm
to another in a domestic relationship.
Mr Henderson said the NT was the first jurisdiction in Australia to consider mandatory
reporting under the Domestic and Family Violence Act.
"Domestic violence tears families apart, and women and children are often the most
vulnerable," Mr Henderson said.
"Enough is enough ... this will not be tolerated anymore."
About half of reported assaults in the NT each year involve violence against women,
with almost two thirds of these alcohol-related.
Almost 3,000 domestic violence incidents were reported to police in the 2007-08 financial
year resulting in 2,594 Domestic Violence Orders (DVOs).
More than 1,800 DVOs were subsequently breached.
But some MPs questioned whether mandatory reporting could do more harm than good, particularly
in small communities.
"Are we going to make it worse when someone tells the police this is happening and
they are threatened with violence (as well)?" said the independent member for Nelson,
Gerry Wood.
The Country Liberals' Jodeen Carney supported the legislation but said it did not go
far enough because it restricted reporting to the threat of "serious harm".
"It provides the ultimate out ... I didn't hit her hard, she wasn't bleeding," she said.
NT Minister for Children and Families Malarndirri McCarthy said the amendment to the
Act was designed to "change society's attitudes".
It was also important for children to know that if their "mother or auntie won't speak
up for themselves others can", she said.
Several domestic attacks made headlines in the NT late last year, including that of
a man charged with murdering his wife.
A 35-year-old woman was also stabbed in the head while a 16-year-old promised bride,
who had tried to kill herself on two occasions, was assaulted by a 50-year-old man.
The NT Government will commit $15 million over four years to support more crisis accommodation,
increased counselling services and public education campaigns about the new law.

Vic: Jail sentence doubled for mother who drugged daughter

MELBOURNE, Dec 23 AAP - A mother who drugged her daughter and left her to be molested
and filmed naked by her defacto partner has had her jail sentence more than doubled.
The woman known only as MS laughed as she mixed sleeping tablets with vodka and orange
juice in 2006, in northern Victoria.
Her partner, known as TDJ, filmed as MS made her 13-year-old daughter swallow the concoction.
MS then removed her unconscious daughter's clothes and left her lying naked in bed.
She left the room knowing TDJ intended to film the teen naked.
TDJ sexually assaulted the girl as he used his mobile phone to take photos of her.
On Wednesday the Victorian Court of Appeal allowed an appeal by the Director of Public
Prosecutions against the leniency of the sentence and increased jail terms handed to both
MS and TDJ.
Two of the three judges hearing the case were in favour of the appeal.
Court of Appeal president Justice Chris Maxwell and Justice Marcia Neave said it was
apparent the crime was a joint enterprise, made worse by MS's abuse of her daughter's
trust.
"What is remarkable - and chilling - about the video is the apparently calm determination
of (the pair) to achieve their objective," the justices wrote in their judgment.
"Plainly enough, (the victim) would never have given consent to any of this occurring."
The justices said the sentences imposed were manifestly inadequate.
"It was, in our view, quite appalling for two adults to overpower the will of a 13-year-old
girl in this way, so as to put themselves in a position to abuse her sexually."
"What makes it worse is that they exploited the daughter's natural trust in her mother
to achieve this result."
TDJ, who pleaded guilty to incest, procuring a child under 16 to take part in an indecent
act and producing child pornography, also faced an additional three unrelated child pornography
counts.
He had his sentence increased from five years and seven months to eight years and six months.
TDJ will be eligible for parole after serving six years.
MS, who pleaded guilty to an indecent act with a child under 16 (related to removing
the girl's clothing), procuring a child under 16 to take part in an indecent act and production
of child pornography, was originally sentenced to one year and eight months in prison,
must now serve four years' jail.
She will be eligible for parole after serving two years and eight months.
Justice David Ashley dissented, ruling the original sentences were appropriate.

Vic: Police try to close bar over alleged home-made vodka

MELBOURNE, Aug 13 AAP - Victoria Police have applied to shut down a nightclub accused
of selling potentially dangerous homemade ethanol-based vodka.
Police raided the Room 99 bar in Geelong and the Ballarat home of its 40-year-old female
owner, Ines Perovic, on Wednesday night.
Police believe the bar could have been selling bootleg vodka, passing it off as premium Smirnoff.
The manager of Room 99, Darren Drummond, told AAP he was disgusted over the allegation
and had quit his job.
Police arrested Ms Perovic and a 55-year-old man, and allegedly seized bottles of alcohol,
large plastic 20-litre containers of liquids and various components that made up a small
home distillery, Geelong acting Licensing Inspector Michael Baker said.
"When you have people making spirits at home ... you do not know what dangerous substances
they are putting in, or about quality control or health issues," he told AAP.
"There were murmurs around town and Geelong is not that big a place.
"There is a myriad of possible charges: obtaining property by deception (deceiving
drinkers into thinking they are buying premium vodka); conduct endangering persons and
Australian Taxation Office issues over excise and manufacturing."
Police also intended to apply, for the first time, for a 24-hour suspension of Room
99's liquor licence under new Liquor Control Reform Act laws, Acting Inspector Baker said.
He said Liquor Licensing Victoria would then apply to have the bar closed for longer.
Alcohol and other substances are currently being tested, with vodka from the bar being
compared with that found at Ms Perovic's home, Acting Inspector Baker said.
"We want a quick testing and turnaround in case there are health issues," he said.
"If anyone has any concerns about their consumption at the bar, they should leave their
details with Geelong police."
No charges have yet been laid, and police plan to interview Ms Perovic and the 55-year-old man.
Ms Perovic could not be contacted on Thursday, but Mr Drummond said she planned to
open Room 99 on Thursday night as usual.
"As far as she is concerned, it will open ... " he told AAP.
The bar has attracted negative publicity recently over underage drinking, security
and management issues, cheap alcohol promotions and a smoking room that did not comply
with the Tobacco Act.

CANBERRA, April 3 AAP - The Rudd government has been both praised and condemned as
hypocritical for officially endorsing a United Nations declaration on the rights of indigenous
people.
Senior indigenous leaders, including Australian of the Year Mick Dodson, said the government
had taken another significant step towards true reconciliation.
But others said the endorsement smacked of hypocrisy and would make little difference
to Aborigines while the intervention in indigenous Northern Territory communities continued.
The government on Friday made good on its election promise to endorse the UN Declaration
on the Rights of Indigenous Peoples, almost two years after the former Howard government
voted against it in the General Assembly.
Australia, the United States, New Zealand and Canada were the only countries to vote against it.
"Today, Australia changes its position," Indigenous Affairs Minister Jenny Macklin
told politicians, dignitaries and Aboriginal leaders at Parliament House in Canberra.
"Today, Australia gives support to the declaration ... in the spirit of resetting the
relationship between indigenous and non-indigenous Australians.
"Today, Australia takes another important step to make sure the flawed policies of
the past will never be revisited."
Professor Dodson said the endorsement was "another great thing, another special thing"
following Prime Minister Kevin Rudd's historic apology last year to the stolen generations.
"This (endorsement) is yet another important piece in the jigsaw that is closing gaps
and healing the relationship," the Aboriginal academic and leader said.
Similarly, Aboriginal and Torres Strait Islander social justice commissioner Tom Calma
said Ms Macklin's statement was a "watershed moment".
"I congratulate the Australian government for the giant step it is taking today in
embracing the fundamental guiding principles of mutual respect and partnership outlined
in the declaration," Mr Calma said.
But others held an entirely different perspective.
Anti-intervention activist Barbara Shaw, from the Mt Nancy Town Camp in Alice Springs,
accused the government of "absolute hypocrisy".
The federal intervention in Northern Territory Aboriginal communities contravened the
declaration, she said.
"The Racial Discrimination Act remains suspended and Aboriginal communities remain
under the control of an explicitly racist government," she said.
Monique Wiseman, from Stop The Intervention Collective, said endorsing the declaration
would not translate into meaningful change on the ground.
"Signing the UN declaration is nothing less than a tokenistic gesture like the apology was."
Ms Macklin said the government was planning to introduce legislation to lift the suspension
of the Racial Discrimination Act in the Northern Territory.
The legislation is due to be introduced in the spring session of parliament, but the
Australian Greens said that wasn't soon enough.
"The blatantly discriminatory suspension of the Racial Discrimination Act in the Northern
Territory intervention must be reversed as a matter of priority," indigenous affairs spokeswoman
Rachel Siewert said.
"The real test is whether they now make their policies consistent with the declaration."
The former Howard government voted against the declaration in 2007 on the grounds it
would elevate customary law above Australian law.
Last week, opposition legal affairs spokesman George Brandis maintained the document
was "deeply flawed".
But Megan Davis, director of the Indigenous Law Centre at the University of NSW, said
the coalition was seriously misguided because the declaration was not legally binding.
While welcoming the change of position, Ms Davis was somewhat suspicious of the government's
true motives.
She suggested the move was aimed at garnering support for Australia's bid for a temporary
seat on the UN Security Council.
"They're getting their human rights house in order," Ms Davis said.
The declaration contains 46 articles which outline rights of an estimated 370 million
indigenous people around the world in terms of international law, but it is not legally
binding and cannot override domestic law.

As if the shoes-off routine, charges for checked bags and missed flight connections were not enough, business travelers now have to cope with a global financial crisis that is diverting their attention as well as rattling their contacts.
It all adds up to a spike in the unusual stresses that plague business travel, from unfamiliar hotels to sudden switches in travel plans. Experts at the Mayo Clinic and Harvard Medical School, along with independent psychologists, agree that road life is more stressful than in the past.
"Back in the 1980s, you could drive to the airport and walk to the gate without thinking of terrorist threats or banks collapsing," said Rex Gatto, a business psychologist based in Pittsburgh. "Now there's only anxiety."
In its latest annual "Stress in America" survey, based on 2,507 online interviews in September, the American Psychological Association found that the crisis on Wall Street was the No.1 cause of anxiety.
And participants in the survey said the places where they felt most vulnerable to stress were in the office and on a business trip.
Researchers have uncovered links between the stress experienced by frequent business travelers and dozens of physical ailments, including some cancers and heart disease. A landmark study of some 10,800 employees at the World Bank in 1997 found that those who traveled accounted for 80 percent more medical claims than nontravelers.
In the current economic turmoil, Nancy Molitor, a psychologist in Wilmette, Illinois, an affluent Chicago suburb, said that many more of her clients had problems related to stress. "In my 20 years of practice I've never seen such anxiety among my banking and business patients," she said.
The globalization of business had already added to the stresses of business travel.
"When you travel in another country with another culture and try to get multitask projects done to meet deadlines, you can feel overwhelmed," said Dr. Abinash Virk, director of the Mayo Clinic's travel program.
Several of the experts said technological advances might be adding to the troubles. "Technology is not the best friend of business travelers," Gatto said. "Getting e-mails all day. Doing a deal on your cellphone while trying to beat the long lines at an airport. Frequent fliers just take on too much."
Dr. Mary FitzPatrick, associate professor at Weill Medical College of Cornell University, in New York, said she believed "the Internet keeps people in touch more than they should," adding: "And there's the CNN phenomenon - a constant, 24-hour barrage of disturbing news."
Of course, stress is not all bad. It can make workers more productive and resourceful. The physiologist Hans Selye, called the father of stress research, identified "good" stress - the adrenaline rush that helps people overcome obstacles - and "chronic" stress, which may easily turn into distress.
Some travelers are better able to deal with the travails of business trips than others. Take a flight delay of several hours, for example.
"When the word comes over the loudspeaker, some passengers take it in stride - watching TV, browsing the shops - while others can't stop running up to the counter for the latest update," said Howard Glazer, associate attending psychologist at New York Presbyterian Hospital. "There you have it - two personality types dealing with the same event. One takes it as a small bump in the road while the other considers it exasperating."
Stress, he added, "clearly is in the eye of the beholder."
Backstopped by many medical studies, cognitive behavior therapists are generally confident that there are effective ways for business travelers to handle stress.
One of the most popular treatments is the stress management system developed in the 1970s by Dr. Herbert Benson, director emeritus of the Benson-Henry Institute for Mind Body Medicine in Boston. His techniques for easing stress range from "meditation on the go" to deep breathing and massages, all described in the book "The Relaxation Response."
Virk, of the Mayo Clinic, said she favored taking time out each day to relax. "Go for a walk," she said. "Think about something unrelated to what you're doing on your business trip. Wherever you are - here or in Cambodia - exercise."
"There are executives who travel a lot and can sleep four hours and still be calm," she said. "Discipline is the key to coping with stress. Veteran travelers know how to break the daily mental process and look at things with a different perspective."

SYDNEY, April 26 AAP - A 36-year-old father of four shot dead in an east Sydney bar
fight was an inspiration and had a heart of gold, his grieving family say.
Solomon Penitani died after being shot in the chest several times in the main area
of Churchill's Sports Bar in Kingsford at 4am (AEST) today, following Anzac Day celebrations.
Maroubra police commander Peter McErlain said police tried in vain to revive the Hillsdale
man at the bar on the corner of Rainbow Street and Anzac Parade.
"It appears that anything up to three shots were fired, and the deceased has suffered
gunshot wounds to the upper part of the body," Superintendent McErlain said.
He said the shooting occurred after several patrons became involved in a fight, and
hotel staff alerted police by sounding an alarm.
"There were a number of people involved in the altercation - whether or not they knew
each other is unknown," he said.
At least 20 people were in the bar at the time.
"The guy walked in and then he pushed another guy and then he pointed the gun to him
and just shoot him," a woman named Linda told the Seven Network.
Mr Penitani's family were in shock today, struggling to understand why a man they described
as an "inspiration" had lost his life in such a senseless shooting.
"He had a heart of gold ... He loved his children, there was nothing he wouldn't do
for his children," Mr Penitani's brother-in-law Peter Rosemond told the Nine Network.
"He is just an inspiration. He would give his last dollar to a complete stranger,"
Mr Penitani's wife Renee Rosemond said.
Ms Rosemond said she and her family needed to know why Mr Penitani was killed.
"It is very important for me and my children to know - we just want closure," she said.
The 24-hour venue had advertised Anzac Day celebrations, including two-up, starting
from 1pm yesterday.
Police have ruled out robbery as a motive and are viewing CCTV footage and interviewing
witnesses who were in the gaming and main bar areas.
"We're also reviewing some very detailed CCTV footage which has been obtained from
the venue," Supt McErlain said.
"It appears that the firearm was a handgun and we are unable to say whether it was
a revolver or a semi-automatic pistol," he said.
Police today searched gardens on a traffic island opposite the bar where the gunman
is believed to have made his escape.
Maroubra taxi driver Moses Moses (Moses Moses) said in his experience Churchill's Sports
Bar was a trouble-free venue.
"I sometimes come in here to the bistro for a meal around 10 to 11pm and it's generally
a quiet pub," Mr Moses told AAP.
"This must have been something to do with someone having an agenda with someone."
Kingsford shop assistant Yvonne Oktacia, 28, said Churchill's had recently been held up.
"It's usually pretty quiet, but the bar was held up a few months ago," she said.
The gunman, described as about 182 cm tall with a solid build, was last seen running
across Anzac Parade after the shooting.

Qld: Customs seize tobacco in Brisbane
Almost 15 tonnes of undeclared tobacco has been seized from a shipping container in Brisbane.
Australian Customs says on December 13 a shipping container .. labelled as containing
noodles .. was selected for X-ray in Brisbane.
Inside officers found almost three-thousand cartons each containing about five kilograms
of tobacco.
Customs says if the cartons found there way onto the market the revenue evaded would
have amounted to more than five million dollars.
Following the discovery officers searched several Sydney homes and are expecting to lay charges.
Under the Customs Act .. penalties up to five times the amount of duty payable can
be imposed on those convicted of smuggling .. conveying or possessing smuggled goods ..
as well as jail sentences.

Foreign Affairs Minister ALEXANDER DOWNER says Iraqis seeking asylum in Australia won't
automatically be granted protection.
But a spokeswoman for Immigration Minister KEVIN ANDREWS says three Iraqi diplomats
and their families will be given sanctuary.
Nine months after the group initially sought refuge in Australia .. protection visas
have been issued to Brigadier General SABAH ABED AL-KAREEM FUREJE .. Colonel KAMAL ASKANDER
.. ALAA HASSAN FATHEL AL-AMIRI .. and their wives and children.
All three were working in the Iraqi embassy in Canberra when they were stripped of
their diplomatic status .. and ordered back to Iraq.
Mr DOWNER says the men are being assessed on their individual circumstances .. and
not because they came from Iraq.
News Limited says Colonel ASKANDER .. his wife IBTISAM and four children faced significant
risk in Iraq because of their Christian faith.
GENERAL FUREJE .. who served under the former regime of SADDAM HUSSEIN .. fears being
killed by gangs because of his past position.

Fed: $46 million to help people with mental illnesses
CANBERRA, Feb 17 AAP - The federal government has launched a $46 million initiative
to improve services for people with mental illnesses.
Assistant Minister for Health and Ageing Christopher Pyne said the initiative would
benefit many Australians suffering from mental health problems.
"This will help improve the quality of life for socially isolated people who have severe
and persistent mental illness by helping individuals to participate in their communities,"
Mr Pyne said.
"People with mental illness will be offered a skill-building program and will be helped
to improve living skills.
"They will be encouraged to develop social networks, build confidence and achieve their
personal goals."
The five-year funding program is part of the government's action plan on mental health.
The new Support for Day to Day Living in the Community Program will benefit from the
government initiative.
"One in five Australians will experience mental illness at some time in their life,"
Mr Pyne said.
"And we know that many people in the community are isolated by their illness.
"This program will help people affected by a persistent and enduring illness to have
a better life."
Mr Pyne invites organisations experienced with mental health to apply for funding.
"Our program is aimed at selected regions across Australia that have a high level of
need but also build upon the variety of support services available," Mr Pyne said.

current frustrations with government regulation.
But he says the Future Fund won't publicly weigh into such debates.

WA: Vietnam vets to lead marches in Perth
PERTH, April 24 AAP - Vietnam veterans will lead tomorrow's Anzac Day marches for the
first time in Western Australia.
The Returned and Services League (RSL) wants to use this year's commemorations to recognise
the 40th anniversary of the Battle of Long Tan on August 18, 1966.
Traditionally, Vietnam veterans hold a separate service for their members in August,
closer to the Long Tan battle date, but the RSL says this year is special for them.
"It's one of the most significant battles that the Australian soldiers participated
in, in the 10 year period they were in Vietnam," RSL WA Branch President Shane Seers said
today.
It was also the first major battle for Australian taskforce deployed to Vietnam, said
Vietnam Veterans Association national president Geoff Trevor-Hunt.
"'Cause we only got there in May-June 1966 and VC and the North Vietnamese decided
they were going to come and teach us a lesson," Mr Hunt said.
"They lost."
He said he wanted to encourage as many Vietnam veterans as possible to take part.
"This is their chance to show... their pride in what they did," Mr Hunt said today.
The last service on the Australian mainland will be a sunset memorial in Perth at Anzac
cottage, said to be the oldest memorial in Australia.
It was built in 1916 by members of the Mount Hawthorn Progress Association.

CANBERRA, April 17 AAP - Australian Progressive Alliance Senator Meg Lees has tipped
further cracks in Medicare following the government's lifting of the safety net threshold.
Senator Lees, who leaves the Senate on June 30 after 15 years in parliament, said the
risk of a cost blowout was raised consistently during debate on the safety net.
But she said the government refused to consider alternatives and declared Treasury
had done the costings and believed there would be no problem.
Senator Lees said the backdown was very disappointing and more so now that the government
would gain control of the Senate from mid-year.
"The Senate being in their hands after July, they could basically do what they like,"
she told ABC television.
"My worry is for those Australians who aren't well, who face a lot of doctors' bills,
specialists bills, GP bills, and I think we will see further cracks appearing and I think
you will see in the future further changes that don't have to be made."
Senator Lees said government control of the Senate meant they would not have to negotiate
with the parliament, although presumably they would still talk with the medical profession.
"The message to them is basically do what you can at the time but be aware that this
government puts economic priorities very high up the ladder and often loses sight of some
of the original aims of a measure," she said.
Senator Lees said the Senate had rejected the government's original Medicare safety
net legislation but it came back with changes and substantially more money.
But they made it clear this was their plan and they would not consider alternatives.
"So it was down to those of us on the crossbenches to try and get the best possible
deal that we could for those people most in need and those are the Australians with chronic
illness, particularly those on low incomes," she said.
"That's why we worked so hard to drop the level at which the safety net cut in, because
for many Australians finding just a couple of hundred dollars ... is an enormous impost."
Senator Lees said the risk of a cost blowout was raised in the Senate committee consideration
of the legislation, in the Senate debate and by Labor in the media.
"The government said to us, well look yeah there is a bit of a risk but treasury has
done the costings and the department has looked forward into the future and said no look
we will wear it," she said.
The government last week said it would lift the Medicare threshold for out-of-pocket
medical expenses, with families, pensioners and health card holders now having to spend
$500, up from $300, before the government picks up 80 per cent of the tab.
For others the threshold will be lifted to at least $1,000, up from $700.

MARTINSVILLE, Va. -- Dale Earnhardt's wife appealed again to keep her husband's autopsy photos private, fearing they will wind up on the Internet for everyone to see.
"I want to let the NASCAR community and the people of Florida know just how much pain this ordeal is causing my family," Teresa Earnhardt said in a statement released at Martinsville Speedway, site of Sunday's race.
Earnhardt was killed Feb. 18 when he crashed during the final lap of the season-opening Daytona 500. Several newspapers and a Web site have sought access to the autopsy photos, saying they wanted a medical expert to review them.
At the time of the crash, autopsy photos were considered public record in Florida, but Florida Gov. Jeb Bush signed a measure late last month making it a felony for a medical examiner to make the photos public.
Infinity a second Hornish IRL victory
HOMESTEAD, Fla. -- The Indy Racing League might have found its young stars.
Sam Hornish Jr., 21, led the majority of the inaugural Infiniti Grand Prix on Sunday and edged 20-year-old Sarah Fisher for his second victory in as many races this season. They also became the youngest 1-2 finishers in Indy racing history.
Hornish also won the season opener at Phoenix International Raceway last month, becoming the youngest winner in IRL history.
Fisher also is making history. Her second-place finish Sunday was the highest of any female driver in a major racing series, besting her third-place finish at Kentucky Speedway last year.
"I certainly think that the more young talent that we get here, the better the series is going to be," Fisher said. "Especially if the young talent is able to stay here."
If Sunday's race is any indication, the youngsters are here to stay. Three other rising stars -- 26-year-old Felipe Giaffone, 26-year-old Didier Andre and 23-year-old Casey Mears -- finished 11th or better in the 26-car field.

SAVANNAH MAN SENTENCED TO 12 YEARS FOR RECEIVING CHILD PORNOGRAPHY.
SAVANNAH, Ga. -- The following information was released by the Atlanta Division of the Federal Bureau of Investigation:
STEVEN E. CRANFORD, 47, of Savannah, Georgia, was sentenced yesterday by United States District Court Judge B. Avant Edenfield to 12 years in prison, followed by lifetime supervised release, for the receipt of child pornography. Cranford will also be required to register as a sex offender. At the conclusion of the sentencing, Cranford was returned to the custody of the United States Marshals Service to serve his sentence.
According to the evidence presented at Cranford's plea and sentencing hearings, Cranford, who worked as an information technology administrator, downloaded thousands of images depicting child pornography on a computer issued to him by his employer. Cranford's collection, amassed over a two-week period, included over 2,300 images and 29 videos of children being sexually abused and exploited. The evidence further revealed that Cranford pled guilty to lewd and lascivious acts with a victim less than 16 years of age, in Florida, in 1998. He had been collecting child pornography images for over 15 years.
United States Attorney Edward J. Tarver stated, "This defendant collected images of children being sexually abused. The act of downloading the despicable images only served to continue the abuse perpetrated on those victims. The United States Attorney's Office will continue to work with federal, state and local law enforcement agencies to prosecute those who facilitate the violent sexual assault of children, and further the market for such images."
This case was brought as part of Project Safe Childhood, a U.S. Department of Justice initiative designed to protect children from online exploitation and abuse. Project Safe Childhood, led by the United States Attorneys Offices, marshals federal, state, and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as identify and rescue victims.
The case was the result of an investigation conducted by Special Agent William Kirkconnell of the Federal Bureau of Investigation. Assistant U.S. Attorney Nancy Greenwood prosecuted the case.
Orange Switzerland changes rate structure.
(ADPnews) - Jun 24, 2011 - Telecommunication firm Orange Switzerland announced yesterday changes to rate structure and a new offer for customers under the age of 27.
With effect from July 27, the company is introducing new basic rate of CHF 10 (USD 11.95/EUR 8.4) per month excluding call minutes for its service Orange Me. The monthly fees now start at CHF 10 instead of CHF 20 and reach CHF 120.
The company will also offer to its customers under the age of 27 a basic rate of CHF 10 per month which includes unlimited calls within Orange network. Young customers can choose a package of CHF 25 a month with 1.0 GB for the mobile Internet.
CEO Thomas Sieber told Swiss news agency AWP that the changes were expected to have a positive effect on Orange's revenue and the number of its customers. The company's business registered a stable development in May and June, he added.
Sieber affirmed that Orange's parent, France Telecom (EPA:FTE), currently had no plans to sell the company.

THE SON of controversial Tory party donor David 'Spotty' Rowland has launched a new investment firm targeting the booming online social network industry.
Jonathan Rowland (pictured) is hoping to grab onto the coat tails of Facebook and Twitter with his Jellybook venture, which will buy stakes in up-and-coming social media firms.
The cash shell will raise around [pounds sterling]3m when its shares begin trading next Friday, although it could tap investors for more in the future if larger deals materialise.
The move comes amid concerns that a bubble is inflating in the internet sector, which could result in a repeat of the technology crash of a decade ago.
Just days ago online voucher company Groupon took aim at a US stock market float expected to value the lossmaking two-and-a-half-yearold firm at more than [pounds sterling]15bn.
But Rowland is no stranger to the wild swings of investing in the online arena after cashing in handsomely from the original dotcom fervour.
At the age of 24 he floated Jellyworks on the London stock market for [pounds sterling]10m. Its value briefly soared above [pounds sterling]200m before it was swallowed up by Shore Capital for [pounds sterling]60m the following year.
The sale netted Rowland an estimated [pounds sterling]42m windfall but Shore had to write off much of its investment following the subsequent crash.
In his new internet foray, Rowland will be joined by other blasts from the past including Julie Meyer, founder of the First Tuesday network for budding entrepreneurs.
Since the heady dotcom days, Rowland has frequently tried but failed to replicate his Jellyworks coup.
In 2005, he launched the Azman investment vehicle which aimed to tap into the then rampant mining sector.
The group subsequently converted into an internet telephone venture following a reverse takeover. Rowland then floated his Nettworx vehicle, which raised more than [pounds sterling]9m to invest in phone technology. After making one small investment, the group was wound up in 2009.
Rowland is currently chief executive of Banque Havilland - the Luxembourg wing of collapsed Icelandic bank Kaupthing which he and his father bought two years ago.
Banque Havilland will act as the underwriter for the Jellybook float. The private bank was recently raided by Serious Fraud Office investigators looking into the Kaupthing scandal.
David Rowland declined to take up the post of Conservative Party treasurer last summer in the wake of allegations about his business dealings and private life.

YouTube fees deal is boost to songwriters; WEB WANNABES: Composers will soon be paid every time any of their work is played on YouTube.

FOR the first time next month the social networking website YouTube willhand over a fee for the music played on ten million videos on its UK site.
The money will be not be just for videos by groups such as Arctic Monkeys andKaiser Chiefs but will also be for the music played on every video created byteenagers pretending to be pop stars and every outlandish 30-second film withmusic in the background.
The deal signed by the Mechanical Copyright Protection Society and thePerforming Rights Society, known as the the Music Alliance, is a world first.
It is likely to set the template for similar deals between social networkingsites and the music industry. The non-profit making Music Alliance - whichcollects royalties for ten million songs - will be the first such organisationin the world to start paying money from this type of website to songwriters,composers and music publishers.
It has been grappling with how to protect its members' incomes in an industrybeing transformed by the growth of digital music.
The YouTube deal, involving a confidential flat fee, follows a protracteddispute with record labels, phone companies and major digital music sup-pliers, including Apple iTunes, over the amount of money to which songwriterswere entitled for a song played on a digital device rather than bought on a CD.
Digital music still accounts for a relatively small proportion of the musicmarket - about 15 per cent globally - but it is growing fast and there are morethan 1.2 million rock songs and 1.7 million R& B songs on the social networkingsite MySpace alone.
The Music Alliance eventually reached its landmark deal, known as the JointOnline Licence, to cover permanent downloads, as well as streaming, whichallows you to listen to music as it is being transferred to your computer.
It also covers webcasting - like broadcasting but using the internet - and liveconcert performances.
Steve Porter, chief executive of the Music Alliance, says: 'It took a long timeto do the deal with YouTube. Taking out a licence makes it a safe environmentfor music to be played and streamed.
' If there is an original track then it will probably be picked up by digitaltechnology and the rights owners' work is protected, and if you are playing aBritney Spears track in the background to a video you have posted then you areprotected, too.' T HE songs are identified by electronic tags embedded in themusic which can be picked up by software, a kind of fingerprinting technologywhich allows music to be digitally identified.
The Music Alliance says its systems have analysed more than 1.5 billionseparate YouTube videos to track their members' work.
The organisation also licenses the mobile phone operators who supply ringtonesand downloadable music. 'This is a fantastic time for writers, composers andpublishers, just as it is for the consumers,' says Porter. 'It is those in themiddle - the retailers and the record labels - which are suffering.' The MusicAlliance still makes money for its 49,000 members the old-fashioned way bycollecting cash for songs played on radio and television.
It also rakes in cash by the more controversial means of selling licences to7,000 pubs and clubs that play music to their customers. It even charges shopsfor playing music in the background.
Last year, the Music Alliance's revenues were [pounds sterling]558 million, of which itdistributed about [pounds sterling]500 million after running costs.
Porter adds: 'We're not doing this for the likes of Elton John to buy flowers,but for the 90 per cent of our members who earn less than [pounds sterling]5,000 a year fromtheir music.'

Conduct nontraditional discovery with ATLA Exchange litigation packet.
Before you file a lawsuit--and throughout litigation--you need to gather as much information as you can without the defendant's involvement. To help you do this, the ATLA Exchange created the Nontraditional Discovery Litigation Packet, which lays out basic strategies for finding and using sources outside of traditional discovery channels.
The packet includes tips for finding information about people, businesses, and assets; conducting literature and intellectual property searches; uncovering a defendant's litigation history; digging up details about health care facilities and practitioners; researching product, workplace, and transportation safety issues; getting facts on trade and industry organizations; and locating government and foreign jurisdiction resources. It also provides an annotated outline of nontraditional resources, supplemented with "how-to-find" examples. Many are cases gleaned from ATLA Education program speakers.
While some public information is easy to find, especially by using the Internet and commercial services, official records are more difficult to get. For instance, you may need to submit Freedom of Information Act (FOIA) requests for official federal and state records that are not normally available to the public. The Nontraditional Discovery Litigation Packet includes a variety of FOIA resources to help you navigate federal and state FOIA and privacy acts.
The big three
In general, there are three primary sources of information about a corporation: regulatory compliance forms, litigation history, and marketing materials. You can combine information from these sources to create a detailed picture of a defendant. The following example of a trucking case illustrates how you can use this information.
Regulatory compliance. You can uncover important information about a motor carrier's safety fitness from the Federal Motor Carrier Safety Administration (FMCSA). Many of the FMCSA's services and databases are free. In them, you can find a "company snapshot"; information on a company's licensing and insurance; a list of out-of-service orders issued by the agency; and, for a nominal fee, a company safety' profile. For another fee, you can get detailed information on commercial and hazardousmaterial shippers through the FMCSA's Motor Carrier Management Information System Data Dissemination Program. Use FOIA requests to discover copies of enforcement, inspection, and crash reports.
Federal and state regulatory filings can provide a comprehensive overview of the carrier. Public companies are required to disclose meaningful financial and other information to the public, which you can access by looking at Securities and Exchange Commission (SEC) filings from the SEC's Electronic Data Gathering, Analysis, and Retrieval system (EDGAR). Some corporations also post their SEC filings on their own Web sites.
Three documents in particular can paint a detailed financial picture of a corporation; reveal litigation it is involved in; and identify corporate officers, directors, and subsidiaries. They are the Annual Report (Form 10-K); the Quarterly Report (Form 10-Q); and the Current Update (Form 8-K) of any material event (for instance, an assets sale, bankruptcy, or litigation) that can affect a company's stock price.
You can also use SEC filings to establish a parent corporation's liability. Look for references to the parent representing the carrier's business as its own, or to the parent calling itself the operator of the carrier's facilities, or cases where the parent acknowledged liability to the federal government for its subsidiaries' unlawful actions.
Litigation history. Many plaintiff attorneys conduct litigation searches using resources like the Exchange, the Law Reporter, and ATLA's list servers. You can use these resources to find lawsuits against a carrier, which would help to establish that the carrier had notice of a hazard; to obtain documents that support punitive damages; and to identify documents produced in other cases that might be helpful in yours. Review cases where an expert testified previously to see what you can expect from the expert's testimony and to find evidence to support a claim that the expert is a professional witness, a depiction you can use to attack his or her credibility.
Supplement information from standard resources with an Internet search. For example, use Google or another search engine to locate litigation information posted to court and other law-oriented sites, and news articles about other collisions involving the same carrier or the same highway location.
Marketing materials. The sources for a carrier's promotional materials include hard copies (such as brochures) handed out to customers, telephone directories, newspapers, and Web site postings. A Web site might include press releases, company histories and timelines, and financial statements. These can identify a parent company, subsidiaries, or a successor in interest; describe the company's structure; and identify past and current company leaders. The carrier's Web site may also discuss company programs. At the very least, advertised promises to "do whatever it takes to deliver cargo on time," for example, can provide good sound bites when you cross-examine the carrier's safety director.
In the end
By thoroughly understanding both a case's subject matter and the defendant, you can craft precise formal discovery requests and deposition questions, which will eventually return the most relevant information. The defense will respond more thoroughly to your traditional discovery requests when it realizes that you already know enough to challenge its credibility based on its refusal to produce requested information or denial that it exists.
